1. Collection and storage of personal data, the purpose of their use and the legal basis for the processing

1.1 When you visit the Site without contacting us or signing in, your browser transmits the following information automatically to the server of the Site:

• IP address of your computer
• Information about your browser (type and, if applicable, the operating system of your computer as well as the name of your access provider)
• Website that you were on right before you landed on our Site (referrer URL)
• URL or file requested
• Date and time of your visit

The information is temporarily stored to ensure a continuous connection and the comfortable use of the Site and is automatically deleted with the end of the session.

The legal basis for data processing is Art. 6 (1) (f) GDPR. The legitimate interest follows from the data collection purposes listed above. In no case TouGas uses the data collected for the purpose of drawing any conclusions about you.

1.2 If you contact us by email or by contact form on the Site, we receive the following information:

• Your email address and further information that you provide by email or input mask of the contact form
• Date and time of your message

The data processing for the purpose of establishing contact with TouGas takes place in accordance with Art. 6 (1) (a) GDPR based on your voluntarily granted consent. As part of an order for products and/or services or other inquiries, we will collect, process and/or use it only to perform the requested and rendered services. The legal basis for this processing is Art. 6 (1) (b) GDPR.

2. Disclosure of data

TouGas does not share, sell or lease personal information about you to any third parties for their marketing use. We will release information about you only if:

• you have given your express consent according to Art. 6 (1) (a) GDPR
• the disclosure pursuant to Art. 6 (1) (f) GDPR is required to assert, exercise or defend legal claims and there is no reason to assume that you have a predominantly legitimate interest in nondisclosure of your personal data,
• in the event that disclosure pursuant to Art. 6 (1) (c) GDPR is a legal obligation, as well if
• such sharing is legally permissible and according to Art. 6 (1) (b) GDPR necessary for the performance of any contractual relationships with you.

If TouGas commissions third parties to process data on the basis of a so-called "commissioned data processing contract", such transfer is made on the basis of Art. 28 GDPR. Such agents and vendors are contractually prohibited from disclosing confidential information, including any personal data TouGas shares with them.

3. Cookies

TouGas currently uses Session-Cookies only. So-called session cookies are used to recognize that you have already visited individual pages of the website. They will be automatically deleted after leaving the Site.


Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or always a hint appears before a new cookie is created. However, disabling cookies completely may mean that you can not use all features of the website. The legal basis for the use of Cookies is Art. 6 (1) (f) GDPR.

4. Analysis tools

TouGas currently does not use any analysis tools.

5. Plug-ins

TouGas currently does not use any third party plugins or services.

6. Affected rights

You have the right:

6.1 to request information about your personal data processed by TouGas in accordance with Art. 15 GDPR. In particular, you can provide information on the processing purposes, the category of personal data, the categories of recipients to whom your data has been disclosed, the planned retention period, the right to rectification, deletion, limitation of processing or opposition, the existence of a right to complain, the source of their data, if not collected from us, and the existence of automated decision-making including profiling and, where appropriate, meaningful information about their details;

6.2 pursuant to Art. 16 GDPR, to demand the immediate correction of incorrect or completion of personal data stored by us;

6.3 in accordance with Art. 17 GDPR, to demand the deletion of your personal data stored at TouGas, unless the processing is required for the exercise of the right to freedom of expression and information, for the fulfillment of a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claim;

6.4 in accordance with Art. 18 GDPR, to demand the restriction of the processing of your personal data, as far as the accuracy of the data is disputed by you, the processing is unlawful, provided however, that you reject their deletion whilst TouGas has no longer need in such data, but you will have the need in connection with the asserting, exercising or defending of legal claims or that you have objected to processing in accordance with Art. 21 GDPR;

6.5 pursuant to Art. 20 GDPR, to receive your personal data provided to TouGas in a structured, standard and machine-readable format or to request transmission to another person responsible;

6.6 pursuant to Art. 7 (3) GDPR, to revoke your consent, once given to TouGas, at any time. As a result, TouGas may no longer continue the data processing based on this consent for the future; and

6.7 according to Art. 77 GDPR, to file a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your place of residence or work or our company headquarters.

7. Right to object

If your personal data are processed based on legitimate interests in accordance with Art. 6 (1) (f ) GDPR, you have the right to file an objection against the processing of your personal data in accordance with Art. 21 GDPR, provided that there are reasons resulting from your particular situation or the objection is aiming against direct marketing measures. In the latter case, you have a general right of objection that TouGas has to obey without specifying any particular situation.

8. Data security

TouGas uses the widely used SSL (Secure Socket Layer) method within the website visit in conjunction with the highest encryption level supported by your browser. In general, this is a 256-bit encryption.
Incidentally, TouGas uses appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or total loss, destruction or against unauthorized access by third parties. TouGas's security measures are constantly being improved in line with technological developments.

9. Updating and changing this privacy policy

This privacy policy is in effect as of May 2018.

As a result of the further development of the Site and offers thereof or due to changed legal or official requirements, it may be necessary to change this privacy policy.
